Webinar: Ethics and Professionalism: Avoiding the Twin Traps of Negligent Referrals and Conflicts of Interests and Best Practices to Protect Yourself
November 21 @ 12:00 pm - 1:00 pm
SPEAKER: Juan Carlos Arias, Esq.
SUMMARY: We cannot practice law in a vacuum, and as Elder Law Attorneys, we often recommend other attorneys and professionals to assist our clients with their objectives during and even many years after we take their case. As caring professionals, we develop relationships with our clients and earn their trust through our work, such that when they are injured in an accident or their home is damaged or they lose their job, they call us for a referral. Furthermore, in Medicaid asset protection planning matters, we often refer non-attorney providers to assist with our asset protection work, encouraging our clients to hire third party providers including pooled trust companies, real estate investment companies, annuity providers, and other professionals such as Care Managers, CPAs, and Financial Advisors. What is our obligation and liability if these transactions do not occur as we expect? Please join the Elder Law Section of the Florida Bar and the Academy of Florida Elder Law Attorneys for a timely Section Service Event presentation by Attorney Juan Carlos Arias on the ethics and professionalism issues surrounding the issues of negligent referrals and conflicts of interest, the latest caselaw, ethics opinions, rules of professional conduct, and best practices and protocols to protect ourselves as attorneys and business owners from the liability inherent in working with other professionals.
